Family Photography Terms and Conditions

Definitions

For the purpose of these conditions ‘the Client’ is any individual who has made a payment to Shaun Barr Photography (‘the Photographer’) for a photography session, along with all attendees of the photography session the payment relates to.

Acceptance of Terms and Conditions
All contracts and transactions between the Photographer and the Client whether made orally or in writing are subject to these terms and conditions which shall be deemed to be incorporated into any contract between the Photographer and all or any of its Clients.

Deposits and Payment

A non-refundable deposit of £50 is payable at the time of booking and deducted from the final balance of the package. Upon payment of the deposit, the Photographer will reserve the client session date. The balance is due on the day of the session. All payments are made via bank transfer.

Cancellation

The Client reserves the right to cancel a photoshoot up until 14 days before the date of the photoshoot for a refund. This does not include the £50 deposit. To cancel, the Client must send written notice via email to the photographer. If in the opinion of the Photographer, inclement weather or other adverse conditions prevent the creation of a photo shoot, Shaun Barr Photography may elect to use an alternate location or to reschedule the photo shoot.

Client Usage

The Client is free to use the images produced and purchased from Shaun Barr Photography how they wish for their own personal use. However, these most not be used for profit and if used in any publication full credit must be given to Shaun Barr Photography. See also Copyright.

Photographer Usage

When booking a photo shoot, the Client gives permission to the Photographer to use the images taken for business marketing, commercial purposes on the website etc.

The entire copyright, title, and intellectual property rights of any images will remain that of the Photographer at all times. The Photographer grants the Client permission to make copies of the images under the following conditions: The images taken by the photographer are for personal use by the Client. Selling, publication or any commercial use of the photographs is not allowed without prior written permission from the Photographer.

For images shared on social media it is requested that credit be given to Shaun Barr Photography.

Client Confidentiality

The Photographer will not disclose to third parties or make use of information communicated by the Client in confidence for the purposes of the photography session.

Waiver of Liability

The client expressly releases the Photographer, his employees and agents from all claims, damages, and liabilities that may result from accidents or incidents that occur during the photo session. If the Photographer is too ill or becomes injured and cannot supply the agreed services, then liability is limited to a refund of any payments received or rescheduling of the session.

Force Majeure

If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. In the unlikely event of total photographic failure or cancellation of this contract by us, liability shall be limited to a full refund of all monies paid.
